NEW YORK CITY CLIMATE MOBILIZATION ACT

“SETTING GOALS OF REDUCING BUILDING EMISSIONS BY 40% BY 2030.”


HIGHLIGHTS & COMPLIANCE:

  • Setting stringent limits on the carbon emissions allowed per building type and square footage
    • Exemptions will apply with alternative compliance paths
  • First compliance date: January 1st, 2024
    • After this date building emissions may not exceed those set for their occupancy group
  • Building emission limits will be set for the following years:
    • 2024-2029
    • 2030-2034
    • 2035-2050
    • 2050
  • New Office of Building Energy and Emissions Performance at the Department of Buildings (DOB)


WHO WILL BE IMPACTED:                                        

  • Buildings 25,000sf and greater
  • Two or more buildings on the same tax lot that together exceed 50,000sf
  • Exempt buildings:
    • Facilities primarily for the generation of electric or steam power
    • City owned buildings
    • NYC Housing Authority property that includes a housing development or building
    • Buildings with more than 35% rent regulated accommodations
    • Religious corporation owned real estate in NYC, used exclusively as a place of public worship


IN THE WORKS:

  • NYC is studying a plan for carbon trading
    • Purchase of greenhouse gas offset or renewable energy credits


FINES:

  • Reports stamped by a registered design professional will be required yearly that illustrate the compliance status of the building
  • First report due May 1, 2025 and every May thereafter
  • Building owners can apply for an extension of time
  • Noncompliant buildings will be subject to a penalty of $268 per tCO2e/sf (metric ton of C02) over

ADDITIONAL REQUIREMENTS:

  • Exempt buildings will have to follow Article 321 of LL97, Energy Conservation Measure Requirements for Certain Building, and implement prescriptive energy conservation measures such as:
    • Repairing all heating system leaks
    • Adjusting temperature setpoints based on occupancy space needs
    • Replace/repair all steam traps
    • Upgrade lighting to comply with the standard for new systems
  • Reports for compliance will be required by May 1st, 2025
  • Penalties will be determined
